Damages Models in Food Labeling Class Actions: Upcoming Roundtable

On Thursday, February 7, Foley Hoag partner August Horvath will join a panel of other authorities to discuss methods of damages estimation in food labeling class actions, sponsored by the ABA Section of Litigation.  Numerous class action suits continue to be brought alleging food mislabeling involving the package size, the nation of origin, the functional and health benefits, or the contents of consumer products. Class certification decisions in these cases have often critically depended on the ability of plaintiffs to develop a damages model (often in the form a “price premium”) that complies with the Supreme Court’s decision in Comcast v. Behrend.

In this program, participants will discuss recent class certification decisions along with the success (and failure) of recently proposed damages models (such as conjoint surveys and “hedonic regressions”).  August will be joined by economist Jon Tomlin of Ankura (f/k/a Navigant Consulting), Professor Robert Zeithammer from the UCLA Anderson School of Management, and moderator Ryan Clarkson of the Clarkson Law firm.  The time of the panel is 2:00 pm Eastern, 11:00 am Pacific, etc.
